General Terms and Conditions (GTC) - Dvin Numismatics Co.
1. Scope of Application
1.1 Applicability
These General Terms and Conditions (hereinafter referred to as "GTC") govern the legal relationship between the buyer (hereinafter referred to as "Buyer") and Dvin Numismatics Co. (hereinafter referred to as "Seller") and apply to all rights of the Buyer regarding articles purchased in the MA Shops online store. By transmitting information in an order, the Buyer agrees to these General Terms and Conditions.
2. Offers and Ordering
2.1 Sales Offer and Product Information
The purchase of items in the MA Shops online store does not constitute a binding sales offer. Illustrations and all information about items purchased in the MA Shops online store are for illustrative purposes only and are not binding.
2.2 Article Availability and Price Changes
The articles will be available as long as they are in stock, but at the latest until the end of the respective sales period. Price and assortment changes are possible at any time. Errors in the publication of the offer do not lead to a binding delivery at the prices mentioned.
2.3 Order Processing and Conclusion of Contract
An order by a Buyer constitutes an offer to a Seller. The contract between the two parties only becomes legally binding when the Seller sends the Buyer an electronic order confirmation.
3. Prices and Payments
3.1 Price Information and Currency
The displayed prices are in Euros.
3.2 Customs, Taxes, and Shipping Costs
The Buyer bears sole responsibility for customs duties, tariffs, taxes, and shipping costs incurred abroad.
3.3 Compliance with Foreign Regulations
Compliance with foreign customs and currency regulations is the responsibility of the Buyer. The Seller is not liable for the Buyer's non-compliance with foreign laws.
4. Delivery, Risk, and Delay
4.1 Delivery and Transfer of Risk
The risk passes to the Buyer upon handing over the goods to the transportation service provider. If the shipment is delayed or cannot be carried out without the fault of the Seller, the risk passes to the Buyer upon notification of readiness for shipping.
5. Warranty and Returns
5.1 Authenticity Guarantee
The Seller guarantees the authenticity of the purchased goods. Further warranties are excluded. Warranty claims are solely the responsibility of the Buyer and cannot be transferred to third parties. For coins in so-called 'slabs,' the warranty expires once they are opened.
5.2 Complaints and Returns
Purchased items must be inspected for defects immediately upon receipt. Complaints about defects must be made in writing without delay, specifying the corresponding objection to the Seller. If the complaint relates to a counterfeit item, the counterfeit item must be returned to the Seller immediately in the condition in which it was handed over to the Buyer. Coins in so-called 'slabs' cannot be returned after opening.
5.3 Expert Advice and Claims
The cost of proving that the item is counterfeit shall be borne by the Buyer. The Seller may require the Buyer to obtain the opinions of two independent and recognized experts in the relevant field at their own expense. These opinions are not binding on the Seller; the Seller may also obtain expert advice at their own expense.
6. Liability and Force Majeure
The Buyer's claim is limited to the refund of the purchase price paid by the Buyer and the return of the purchased item to the Seller if the defect is duly notified. Further or other claims of the Buyer against the Seller are excluded. In particular, no liability is assumed for consequential damages such as lost value. The Seller is not liable for damages caused by force majeure, riots, wars, natural disasters, or other circumstances beyond the control of the Seller, such as strikes, lockouts, traffic disruptions, and official orders in both domestic and foreign situations.
7. Place of Fulfillment and Jurisdiction
Place of fulfillment and exclusive jurisdiction for all claims and disputes arising from or in connection with these General Terms and Conditions and the concluded transactions is Zurich, Switzerland, the registered office of the Seller.
8. Applicable Law
For the sale of the purchased goods and all related legal transactions, exclusively Swiss law shall apply. The application of the Sales Law and the collision norms of the United Nations is excluded.
9. Interpretation of the Contract Text
In the event of linguistic differences and other ambiguities in the content of the German, French, English, and Italian versions, the German original text of the General Terms and Conditions shall prevail.
10. Severability Clause
Should individual provisions of these General Terms and Conditions be wholly or partially invalid or unenforceable, the effectiveness of the remaining provisions shall remain unaffected. In place of an invalid or unenforceable provision, a regulation shall apply that comes closest to the economic purpose of the invalid or unenforceable provision.
